Last chance. Wednesday 30 June is the deadline for most European Union (EU) citizens to apply to live permanently in the UK as settled residents.

The take-up of the European Union Settlement Scheme (EUSS) has been huge - but there are serious concerns that thousands of people have still not sought to register. Anyone who is not registered loses their legal right to live in the UK.

What is the EU Settlement Scheme?

The EUSS was launched in March 2019 to register EU citizens as settled residents in the UK.

This is a follow-on from Brexit, which ended freedom of movement and the right of people from the EU to come to the UK - and for UK citizens to go the other way.

By the end of May 2021, 5.6 million people had applied for the scheme - far more than expected (it was estimated in March 2019 that there were 3.7m EU nationals in the UK).

Who can apply?

Anyone who can prove they have been living in the UK continuously for at least five years before the end of 2020, can seek "settled status" - legal recognition that they live here permanently.

Anyone who shows they have been here for less than five years gets "pre-settled status".

This gives them the right to continue living in the UK - but they then have to make a application later on for full settled status.

What happens if people do not apply?

Some experts believe there could be more than 100,000 people who will fail to apply before the deadline.

Anyone who has not applied or received a status would technically become an illegal immigrant overnight and face problems:

·        it would be illegal for them to work

·        they would no longer be able to receive benefits

·        they would face huge charges for using the NHS

In England, private landlords must check the immigration status of tenants - and the housing charity Shelter predicts this will be a disaster.

Who could have missed the deadline?

There may be people from all walks of life who fail to register in time - but migration experts, lawyers and charities have identified a range of people who they are concerned about:

EU children

Children whose parents came to live and work in the UK under the pre-Brexit freedom-of-movement rules, but who never sought permanent settled status under British immigration laws.

These children cannot be sure they are British citizens or legally entitled to remain in all circumstances. The same could apply to children who are not yet born.

Marianne Lagrue from the Coram Children's Legal Centre says the numbers of EUSS applications for children are far short of what would be expected - meaning there could be thousands in this category.

As they leave compulsory school-age education, these children would be legally forbidden from going to colleges, universities and into work.

The Home Office has identified that there are more than 3,600 EU children in the care system. As of late April, EUSS applications had not been lodged for 1,220 of these.

Elderly EU citizens

EU citizens who arrived before the UK joined the European Union in 1973 are generally already allowed indefinite leave to remain.

However, there will be elderly people who came after that date who may have no proof of their legal residence in the UK, and may not realise that they need to apply to the EUSS.

Benefit claimants

A Whitehall leak last week revealed that officials have calculated that 130,000 of 820,000 European Union citizens eligible to claim one benefit or another, have not applied to the EUSS.

EU citizens registered under an old scheme

After the Brexit vote, there was a surge in applications to a previous scheme which confirmed permanent residence - some 390,000 cases.

But that document is now legally worthless. Nobody can rely on it anymore as legal proof of permanent residency.

Vulnerable groups

There will be EU citizens in the UK from poor and marginalised backgrounds who may not even know they should be applying to the scheme.

One example would be men and women trafficked by criminal gangs into modern-day slavery, such as the sex trade. Another would be victims of domestic abuse whose lives are controlled by their partners.

Oxford University's Migration Observatory has identified many other groups who could be affected.

How long do you have to make a late application?

The government is promising a "pragmatic and flexible" approach to late applications.

It says that anyone who has received a certificate proving they have applied will have their legal rights protected while officials process their paperwork.

Broke immigrant to millionaire!

During the last 20 years, I’ve met thousands of successful people have who migrated to the UK, but the person sticks out in my mind is someone who was not only broke when I met her, but also deep in debt with a terrible credit history.

 

She was an immigrant to this country who came here with nothing to declare except a burning ambition to succeed.

 

There was something about her that told me that she had a powerful hunger and desire to build a better life for herself and her daughter.

 

Although she had always worked hard, she instinctively knew that hard work alone was not enough.

 

After I started mentoring her and gave her 3 steps to follow, this single mum got herself together and changed her money habits.

 

3 steps to financial success

 

Step 1 Where are you now?

 

We took stock of exactly where she was, what money was coming in and where it was going. Most people have no idea “where it all goes”.

 

Step 2 Planning

 

Having established where she was, we started planning her financial journey out of debt and towards financial freedom. Most people have no plan, no roadmap and simply live week-to-week.

 

Step 3 Financial education

 

The next step was education. She took on board financial education and learned fast! She learned how to start accumulating and attracting money and use other people’s money (OPM) to become financially free.

 

This student was very teachable and eager to learn. Whereas a lot of people say, "I can’t do that" or “it can’t be done” and “only the rich can do that”, she would take instruction on board and say, "done that, what next?"

 

I was proud of her achievements but cannot take full credit. I may have pointed her in the right direction, but she took the action. She did not just sit around chanting and waiting for the ‘universe’ to send her money in the post.

 

In the following 5 years she built up over £1 million in property and business assets

 

She worked hard of course, no harder than she would have plodding along in a job for 40 years.

 

Yes, she had to put in a bit of extra effort at the start, but that saved her years of work, and enabled her to retire young to pursue her passion in politics and charity work.

 

She also paid to educate her nephew and niece by sending them to university back home. They became nurses and she helped them get jobs here for the NHS - a passport to a lifelong stream of income!

 

With the best intentions in the world, she could never have done all this without money.

 

Enjoying the fruits of your success.

 

Being financially free meant she had choices in life. The opportunity to travel when she wanted to, meet friends for lunch or go shopping for the day with the girls.

 

Time freedom to enjoy with her family without having to ask permission from her boss.

 

 She was also able to exchange her old Nissan Micra for a shiny new Porsche!

 

However, she only bought a new car when she had built up capital and passive income from property and business assets to be able to afford it.

 

The car was an outward expression of her wealth, but the real wealth was in her property and business.

 

The UK is open for business and encourages entrepreneurship. Starting a limited company is simple with far fewer restrictions than other European countries. Non-UK citizens are also allowed to own property and businesses.

 

Of course, she is not alone in the millions of immigrants who have hunger and passion to succeed. There’s something about the character of a person who leaves everything behind to make a new life abroad. British migrants have done extremely well in Australia, Canada and America.

 

If someone can come here starting with nothing, with no money, no local knowledge or contacts, as well as a language barrier and still make it, anyone can.

UK Property Boom Continues As House Prices Soar By 10.9% And Sales Forecast To Rise To The Highest Level Since The 2007 Market Peak

British house prices leaped by an annual 10.9%, the most in almost seven years, and they look set to rise further as people search new homes after the pandemic, one of the country’s largest mortgage lender the Nationwide said.

Almost 70% homeowners considering a move said they would still go ahead even without the unlikely extension of a tax incentive by Chancellor Rishi Sunak, Nationwide said, according to a survey it conducted in late April.

The latest figures demonstrate the scale of the surge in house prices which hit a new record high at an average of £242,832, according to Nationwide, which whilst not the official Land Registry data is widely respected by the industry.

Nationwide added that house prices were 1.8% higher than in April.

Nationwide said there was scope for annual house price growth to accelerate further in the coming months, given how weak the housing market was in early stages of the pandemic.

However, if unemployment rises sharply later in 2021 - when Sunak's jobs protection programme is due to expire - there was scope for activity to slow, perhaps sharply, it said.

Official data from the Office for National Statistics has shown that house prices in March jumped by just over 10%, the largest annual rise by that measure in nearly 14 years – prior to the 2007 peak and later property and stock market crash.

Not all areas are booming and parts of London are seeing sharp price reductions on flats.

Coastal hotspots - in Devon, Cornwall and Dorset - have seen house prices rise by as much as 48% in a year as people ‘escape to the country’!

One million Britons fear losing homes when eviction ban ends - as up to 400,000 tenants have already been served notice or told to expect it due to unpaid rent over pandemic, The Daily Mail reports.

The tenant eviction ban expired on 1 June, which could see thousands of people with rent arrears evicted by bailiffs.

·        Ban lifted meaning bailiff-enforced evictions can take place from now

·        Government introduced ban to support renters through the Covid-19 pandemic 

·        Charity says that 400,000 renters have already been served with eviction notice

·        A further 450,000 households are in rent arrears according to research

The Joseph Rowntree Foundation said 400,000 have already been served with an eviction notice or told they may be evicted and a further 450,000 households are in arrears with rent, JRF said. 

In practice, possession claims leading to eventual eviction could take 6-12 months to go get through the county court system, which is already overloaded with all manner of legal cases.

Over 60% of buy-to-let landlords own just one property and many of whom are paying mortgages with little or no chance of recovering thousands of pounds of rent arrears built up during the lockdown.
