US immigration agency job cuts will bring visa system to a halt

The US federal agency responsible for immigration, processing visa applications and approving citizenship is threatening to furlough more than half of its workforce unless Congress provides additional funding, according to a spokesperson.

The US Citizenship and Immigration Services (USCIS) is preparing to furlough 70 percent of its staff, unless it receives fresh funding, which would bring an already backlogged system to a virtual halt.

USCS, an agency of the Department of State largely depends on fees from new immigration applications for its operations, now faces an historic budget shortfall.

This comes at a time when President Donald Trump’s 2020 re-election campaign manifesto highlights slashing legal and undocumented immigration to America.

Already the number of new immigrants to the US has been dramatically curtailed by new regulations, executive actions and travel restrictions introduced to combat the coronavirus pandemic.

The agency has seen fee income decline by 50% since March has requested a $1.2bn bailout from Congress to avoid drastic staff reductions.

"On or before July 2, approximately 13,400 USCIS employees will receive notice that if USCIS must proceed with an administrative furlough, they would be furloughed beginning August 3," the USCIS spokesperson's statement said.

Staff furloughs "will for sure cause noticeable delays immediately," one USCIS employee, who asked not to be named, told the Reuters News Agency. "There are already so many backlogs to work through. It's insane to even contemplate how bad this is going to get."

This week, Trump signed a presidential proclamation banning US entry under a number of categories of temporary visa holders. He also extended the ban on some green card applicants, which the administration said would help open more jobs for unemployed Americans.

The move may win Trump votes, but could also hurt the beleaguered US economy, which has seen many States put the brakes on reopening for business following a spike in Coronavirus Covid 19 cases.

Is it legal for illegal immigrants to pay U.S. taxes?

The issue of illegal immigration has been a thorn on the side of every political candidate in the US. Of course, the topic has had a fair share of airtime in last year's presidential debate; however, the plans to address the issue have been very vague and there is a lack of laws that specifically answer the problems point by point.

But before we go into details of the efforts done in addressing the problem, let us first get to the bottom of why there is a massive call to stop illegal immigration.

There is a long list of negative effects of illegal immigration put forward by certain groups and one that has been often highlighted is the issue on tax.

As cited by anti immigrant proponents, the illegal aliens drain much of the tax-based resources and Americans stand to lose in this situation because they are the taxpayers. Proponents have vehemently claimed that immigrants do not pay taxes and yet they use up many tax-based resources. Add to that the government's cost on maintaining these illegal immigrants.

Now, this begs the question, "Do illegal immigrants pay taxes?"

The answer to the question is yes and no. Contrary to popular belief, many illegal workers do pay their taxes. This is not just a product of a very creative mind; it is a fact that has been acknowledged by none other than the Federal Government.

In 2008, it was estimated that about $9 billion dollars worth of tax was paid by illegal immigrants. This is despite the fact that they are not eligible for tax credits or Social Security benefits. The amount is substantial enough to merit a large contribution from the often maligned minority group in the country.

Of course not all illegal workers pay taxes, but for those who do, the contribution is substantial enough to add funds to Medicare and Social Security, which benefit Americans more than the illegal aliens. What does this mean? It means that there is substantial funding from illegal migrants that would benefit the baby boomers who are now in the retiring age. Not many people know this fact and they condescendingly ask:

"Do illegal immigrants pay taxes?"

Given the important contribution of illegal migrants when it comes to paying taxes, anti illegal immigration groups have continued to express their sentiments on the government's inability to track down illegal aliens and deport them to their respective home countries.

While nationally, there is no law that would force authorities to keep track of illegal immigrants, Arizona has passed a law that could be the spark that would ignite a major crackdown on these illegal aliens.

Word is that several states near the US-Mexico border are seriously considering following suit, but they are proceeding with caution and planning things secretly. They are said to be closely monitoring the developments in Arizona and playing things by ear. Perhaps if they know the answer to the question, "Do illegal immigrants pay taxes?" they would not be too hasty in passing discriminatory laws designed to track down illegal immigrants. Four jailed over sham marriage scam UKBA reports

The UK Border Agency reports that four people have been jailed for a total of more than six years for their part in a sham marriage scam involving Nigerian and Dutch nationals.

The investigation was triggered when our officers identified the suspicious travel patterns of passengers flying in and out of Luton and Stansted Airports on tickets purchased by Adeolu Eletu, a 29-year-old Nigerian.

On 10 February, our officers from the immigration crime team (East), arrested Daniloush Solano, a 21-year-old Dutch woman, at Luton Airport as she attempted to board a flight to Amsterdam.

Investigations revealed that earlier that day Solano had married Eletu at a church in Wood Green, London. She was paid 1,500 euros for her role.

Eletu was subsequently arrested on 27 February at his home address in Falcon Brae, Livingston. His Nigerian girlfriend Helen Omoboye, 33, was also arrested. She had been due to participate in a sham marriage of her own at the same Wood Green venue on 11 February.

Sylvernus Ogungbade, a 36-year-old Nigerian, was also arrested on 10 February after officers established that Solano had caught her taxi to Luton Airport from his home in Goldbeater's Grove, Edgware. Immigration checks revealed that Ogungbade, who was living alone, had recently applied for a visa on the back of his marriage to a Dutch woman who is still wanted by us.

Last week at Luton Crown Court, Eletu, Ogungbade and Omoboye pleaded guilty to conspiring to breach the UK's immigration laws. Eletu and Omoboye also pleaded guilty to perjury charges.

Eletu was sentenced to two years eight months, Omoboye was sentenced to 18 months and Ogungbade was sentenced to a year and eight months. Solano had pleaded guilty to charges of conspiring to breach the UK's immigration laws and perjury at an earlier hearing on June 10. She was sentenced to 12 months.

Sam Bullimore, assistant director, UK Border Agency said:

'The sentences handed out show how seriously we, and the courts, take these kinds of attempts to undermine our immigration laws.

'We will not tolerate immigration abuse and, as these convictions demonstrate, our immigration crime teams are creating a hostile environment for those who break the immigration laws. We know that sham marriage rackets are not just about getting a ticket to the UK, often the offenders are also involved in other forms of criminality. If we see marriages that are not genuine, we will challenge them and prosecute where appropriate.

'People should be under no illusion that marriage is not enough to get permission to stay in the UK. Couples must also prove to the UK Border Agency that they have been in a genuine relationship for at least two years.'

Any foreign criminal sentenced to more than 12 months in prison for any offence is automatically considered for deportation. Source: UK Border Agency

Global Recession leading to stricter immigration rules

The effects of the recession have seeped into other aspects of policy around the world — including immigration.

Stemming from increased unemployment rates, many countries made changes to migrant policy that largely encouraged both migrant residents to leave and discouraged new immigration from beyond their borders, according to a study by the Federal Reserve Bank of Dallas.

As immigration rates rose between 2000 and 2007, unemployment rates rose in the two subsequent years in countries around the world, say Mike Nicholson and Pia Orrenius, the report’s authors. The migrant population in Spain, for instance, increased from just under 1 million in 2000 to almost 5 million in 2007. Spain’s unemployment rate jumped to 19% from 8.8% between December 2007 and December 2009. Immigration patterns in the U.S., however, remained unchanged from the 1990s as unemployment rose to 10% from 5%.

As a result, Ireland, Spain, the U.S. and the U.K. — among others — adopted policies that would limit immigrants’ access to the labor force. The Troubled Asset Relief Program in the U.S. discouraged banks receiving stimulus funding from hiring foreign workers, and an executive order this year created stricter regulations for foreign farm workers.

Ireland discontinued work permit issuance to immigrants for low-paid positions in 2009 and created stricter rules for work permit renewals. The U.K. increased salary and education standards for non-EU high-skilled workers and passed stricter citizenship requirements.

Many countries created policies that encouraged migrant residents to return to their home countries. Spain’s program, implemented in 2008, made two payments for unemployment benefits to migrants for leaving the country — one in Spain, the second after the person had returned home. Participation in the program prohibits return to Spain for three years. Japan and the Czech Republic created similar programs.

Overall, illegal migration has declined as authorities tighten enforcement on labor migration, though family and humanitarian migration has remained steady.

Effects of the migration resistance could peak after the recession ends, the authors say. Demand for labor and migration are expected to rebound as the economy recovers, but increased demand could clash with restrictions on foreigners in the labor market.

“These could impede countries’ ability to recruit workers in sectors vital to their recovery and long-run economic growth,” the authors say.

But some countries have already started reversing migration policies enacted during the recession. Switzerland, for example, has upped some of this year’s work permit quotas after cutting them in half at the beginning of the year, and Malaysia is permitting some foreign recruitment in manufacturing.

Revised Green Card Form I-9 Documentation

On May 11, 2010, USCIS (U.S. Citizenship and Immigration Services) announced it had redesigned the Permanent Resident Card, which most of us know more commonly as the Green Card. In a moment of sheer genius, the designers of the "Green" Card actually decided to make it green in color for ease of recognition!

A Green Card is proof of authorization to live and work in the United States. A newly issued Green Card is valid for 10 years for lawful permanent residents and 2 years for conditional residents.

Some existing Green Cards have an expiration date - these cards will remain valid until they expire. Holders of Green Cards with an expiration date will receive the redesigned version when seeking a renewal or replacement.

Other existing Green Cards have no expiration date. These cards remain valid however; USCIS is recommending that people who have a card without an expiration date apply to replace their cards with the newly redesigned version.

Evidence of Work Eligibility

The intent of the newly redesigned Permanent Resident Card is to help prevent immigration fraud. The new Green Card incorporates state-of-the-art technology to prevent counterfeiting and facilitate accurate authentication. The enhanced features are intended to be useful to law enforcement, employers, and immigrants - all of whom look to the Green Card as definitive proof of authorization to legally live and work in the United States.

Although this seems to be a positive step in decreasing incidents of identity theft and document fraud, it actually creates more uncertainty for employers. It becomes the employer's burden to identify legitimate documents when many employers are not familiar with every version of the Green Card issued over time.

There have been several versions of the Green Card issued over the years. The first Green Card was issued in 1946 and at that time was referred to as an Alien Registration Receipt Card. Few of these are still in circulation. They contain no expiration date and as of March 20, 1996 are no longer valid evidence of permanent residency. Other versions of the Resident Alien Card were issued in 1977 and again in 1989. Oddly enough, neither the 1977 card nor the 1989 were green in color.

In 1997, the card was renamed the Permanent Resident Card. It was updated yet again in 2004. Every time the card has been updated, additional security measures have been added. As for the most current version, holders of older cards will only receive the redesigned Permanent Resident Card when seeking a renewal or replacement card.

Recipients of the redesigned Permanent Resident Card will include those newly approved lawful permanent residents, as well as those who get a renewal or replacement card. As of May 11, 2010 the cost of renewing or replacing a Permanent Resident Card was $370.

Filipino domestic workers struggle for justice say ABS CBN

ABS-CBN's Niña Corpuz, the author of the article, "Filipino Domestic Workers: between justice and survival," won the 2010 edition of the journalistic prize for the best story on labour rights, awarded by the International Training Centre of the ILO (ITC-ILO), the training arm of the ILO.

The article was selected among stories written by professional journalists who attended the training courses on "Communicating Labour Rights," yearly organized by the ITC-ILO.

The courses introduce journalists and media professionals from all over the world, to international labour standards, with the aim of raising public awareness of their relevance to local labour and social issues.

The award ceremony was held in Turin, Italy, on Monday 21st June 2010 at the ITC-ILO.

Niña Corpuz is a broadcast journalist for the Philippine's biggest TV network, ABS-CBN Broadcasting Corporation. She has been a reporter for 9 years, covering labour, education, health and politics. She also anchors a television news program entitled "Balitang Europe" (News from Europe), which tackles the concerns of overseas Filipino workers in
Europe.

Niña also hosts a public service radio program, with Philippine Vice-President Noli de Castro, on ABS-CBN's AM station, DZMM, the No. 1 radio station in the Philippines. Canada takes on rogue immigration consultants

People seeking help to emigrate to Canada are set to be better protected after the Canadian government announced new legislation to deal with fraudulent immigration consultants.

Britons are among thousands exploited by the so-called crooked consultants, who are paid “extortionate amounts of money” by potential immigrants duped into believing they can guarantee them visas, for example, reduce the wait time for applications or claim to have connections in the Canadian immigration department who will expedite the process.

The national police force, the RCMP, and the Canada Border Services Agency are reportedly dealing with hundreds of current investigations into allegations against unscrupulous consultants across Canada. Around a quarter of a million people worldwide emigrate to Canada every year, while the number of immigrants settling from the UK has doubled in the past decade from approximately 4,500 in 1999 to 9,500 last year.

The Canadian government’s ‘Cracking Down on Crooked Consultants Act’ aims to close a loophole in the current legislation, which does not regulate any consultants’ involvement in the pre-application period. If passed, it would require all paid-for advice or representation be provided by an authorised immigration consultant, lawyer or notary only. It would also give the government power over the body governing immigration consultants “in order to ensure the integrity of the process”.

Jason Kenney, Canada’s minister of citizenship, immigration and multiculturalism, said at an earlier conference that, while most immigration consultants working in Canada were professional and ethical, “the unfortunate reality is that many consultants are acting dishonestly or even illegally to profit from people’s dream of coming here.” He cited one case of an exorbitant fee of $90,000 (around £60,000) paid to a crooked consultant by an immigrating family. “These prospective immigrants often find out too late that they’ve been deceived,” Kenney added

While the legislation of course covers Canada only, the minister will be also encouraging foreign governments to tackle the problem of crooked consultants dealing with immigrants to Canada. Jason Kenney is in London next week to talk about these and other immigration issues with Home Secretary Theresa May and Immigration Minister Damian Green as part of the Five Country Conference, comprising the UK, Canada, the US, Australia and New Zealand.

If anyone is defrauded by an immigration consultant in the UK, they are advised to file a complaint with the local police and inform the Canadian Embassy, said Kelli Fraser, media relations adviser for Citizenship and Immigration Canada.

She pointed out that immigration fraud happens, of course, around the world not just in Canada, but added that it threatens the integrity of Canada’s immigration system. “It also raises security concerns, wastes tax dollars, adds to the processing time for legitimate applications, and it is unfair to those who do follow the rules,” she said.

The cost of obtaining a green card, business visa and other US immigration benefits will increase an average 10% under a proposal announced Wednesday by federal immigration officials.

But in a move hailed by immigrant advocates, officials decided not to propose fee hikes for US citizenship applications, one of the largest and most politically popular categories of immigration benefits.

That this House notes that the legal advice charity Refugee and Migrant Justice (RMJ) is in danger of closing because it is facing a cash crisis because a large proportion of legal aid work is now paid upon completion, meaning payment can take anything up to two years; further notes that as a result the charity has a £1.8 million backlog of payments; further notes that senior legal and human rights experts, faith leaders including the Archbishop of Canterbury, Citizens Advice, Liberty and Mind all back the campaign to rescue the legal advice charity from the cash crisis that is not of their own making; is aware that RMJ is not asking for new money but simply prompt payment of legal aid by the Legal Services Commission, or failing that, interest-free loans by the Government to cover the gap; and calls for the legal aid payment system to be changed to ensure charities are paid promptly for their work.
