Canada Announce Cap On International Student Visas

Canada has introduced a surprise cap on student visas in an apparent U-turn on previous policies to welcome international students.

The Honourable Marc Miller, Minister of Immigration, Refugees and Citizenship announced this week that the Government of Canada will set an intake cap on international student permit applications - approximately 360,000 approved study permits, a decrease of 35% from 2023 - to “stabilize” new growth for a period of two years.

Study permit renewals will not be impacted and existing study permit holders will not be affected by the new cap.

The government said:

“In recent years, the integrity of the international student system has been threatened. Some institutions have significantly increased their intakes to drive revenues, and more students have been arriving in Canada without the proper supports they need to succeed.

“Rapid increases in the number of international students arriving in Canada also puts pressure on housing, health care and other services. As we work to better protect international students from bad actors and support sustainable population growth in Canada, the government is moving forward with measures to stabilize the number of international students in Canada.”

Individual provincial and territorial caps have been established, weighted by population, which will result in much more significant decreases in provinces where the international student population has seen the most unsustainable growth.

Master’s and doctoral degrees, and elementary and secondary education are not included in the cap.

IRCC will allocate a portion of the cap to each province and territory, who will then distribute the allocation among their designated learning institutions. To implement the cap, as of January 22, 2024, every study permit application submitted to IRCC will also require an attestation letter from a province or territory. Provinces and territories are expected to establish a process for issuing attestation letters to students by no later than March 31, 2024.

The new “temporary measures” are expected to run for two years, with the number of new study permit applications accepted in 2025 will be re-assessed at the end of this year.

In order to better align the Post-Graduation Work Permit Program, the government also published the following changes to the eligibility criteria:

• Starting September 1, 2024, international students who begin a study program that is part of a curriculum licensing arrangement will no longer be eligible for a post­graduation work permit upon graduation. Under curriculum licensing agreements, students physically attend a private college that has been licensed to deliver the curriculum of an associated public college. These programs have seen significant growth in attracting international students in recent years, though they have less oversight than public colleges and they act as a loophole with regards to post-graduation work permit eligibility.
• Graduates of master’s degree programs will soon be eligible to apply for a 3-year work permit. Under current criteria, the length of a post­graduation work permit is based solely on the length of an individual’s study program, hindering master’s graduates by limiting the amount of time they have to gain work experience and potentially transition to permanent residence.

Open work permits will only be available to spouses of international students in master’s and doctoral programs. Spouses of international students in other levels of study, including undergraduate and college programs, will no longer be eligible.

The government said the important measures announced “complement” other recent reforms to the International Student Program.

New cost-of-living requirement for international students coming to study in Canada

In December, the Immigration, the IRCC doubled the cost-of-living requirement for international students from CAD 10,000 to CAD 20,635. Inflation and financial challenges faced by many international students were blamed for the sudden move, with the government claiming the change aims to ensure students are better prepared for the actual cost of living in Canada.

The backlash against international students should be seen in the context of a housing crisis, an upcoming election for the Trudeau government and an ongoing diplomatic row between Canada and India.

There is still a shortage of nurses and healthcare workers in Canada, and many other western countries such as Australia, UK and the US, and student schemes help to alleviate the recruitment issues.

The Worldwide Health Organisation, World Economic Forum (WEF) and the UK’s Nursing and Midwifery Council (NMC) all report that there is a huge global shortage of nurses expected to reach 13 million by 2030, according to the WEF.

Reasons for the nursing staff shortage range from ‘burnout’ of western nurses to an aging population in countries like the US, UK, Japan and Canada.

According to the Canadian Nurses Association (CNA), there is a current shortage of nurses in Canada estimated at more than 50,000 and this shortage is expected to increase to 139,700 by 2026.

The CNA also reports that the nursing workforce in Canada is aging, with nearly one-third of nurses aged 55 or older.

As these nurses retire, the demand for nursing services will continue to grow. In addition, the aging population in Canada will also increase the demand for healthcare services.

Global Health Emergency Due To Acute Shortage of Nurses In Western Countries Like Canada, But Also In Africa, India And The Philippines

The Worldwide Health Organisation, World Economic Forum (WEF) and the UK’s Nursing and Midwifery Council (NMC) all report that there is a huge global shortage of nurses expected to reach 13 million by 2030, according to the WEF.

The Nursing Times goes even further claiming a shortage of 30 million nurses across the world, including in countries that provide nurses for international recruitment, leading to a global health emergency, according to the latest report from the International Council of Nurses.

The shortage of nurses across the world now extends to countries that provide nurses for international recruitment, such as India and The Philippines.

The latest ICN report reveals that countries that have a tradition of training nurses in order for them to emigrate to work in higher income countries, such as Australia, Canada, US and the UK, are experiencing their own nursing shortage.

The government in the Philippines has now acknowledged a shortage of up to 350,000 nurses, but thousands of nursing degree graduates end up working in call centres due to a lack of training and job opportunities, while private universities churn out hundreds of thousands more graduates each year.

Nurse recruitment from India and The Philippines accounted for 67% of all internationally trained staff that joined the NMC register in 2021-22.

Low pay and opportunities to migrate to the West continues to fuel a strong demand from Indian and Filipino nurses. Thousands are applying for nursing jobs or nurse conversion courses in Canada Australia, Middle East, UK and the US.

The report, Recover to Rebuild: Investing in the Nursing Workforce for Health System Effectiveness, lays out the devastating impact that the Covid-19 pandemic has had on nurses around the world.

Canada to recruit 400,000 new immigrants a year to boost economy

Canada has announced that it will increase immigration into the country and simplify the process in order to help the economy recover and grow

Canada aims to accept over 400,000 permanent residents each year under the 2021-2023 Immigration Levels Plan. The focus of the new plan will be geared towards economic growth, with the Economic Class accounting for 60% of new admissions.

The new Canadian migrant visas are aimed at increasing numbers of people through the following programmes:

·        Self-Employed Persons Program

·        Federal Skilled Trades Program

·        Federal Skilled Worker Program

·        Canadian Experience Class  

·        Start-up Visa

In recent years, Indians have made up the largest nationality to obtain permanent residency in Canada. Migrants have been helped by a more straightforward path to citizenship, as well as schemes aimed at attracting entrepreneurs and highly skilled workers.

According to immigration analysts, the main reason behind increased migrants from the US to Canada is the confusion surrounding the H-1B scheme, as well as the extremely long waiting times for a US green card for Indians.

Marco E. L. While Immigration, Refugees and Citizenship Canada (IRCC) continued to accept and process applications throughout the pandemic, global travel restrictions and capacity constraints resulted in a shortfall in admissions in recent months.

In my Money Tips Podcast this week, I interviewed Toronto native, Jas Takhar, co-founded the REC and real estate firm Royal LePage.

Jas, who runs one of the leading real estate companies in Canada and is the author of the book Real Estate Intelligence, pointed out that around three times more homes will need to be built to accommodate new arrivals as well as fast-growing local demand in a hot property market.  

Canada has been a popular destination for migrants from all over the world including Hong Kong, India, The Philippines, Africa and European countries. This is due to a number of factors, such as Canada’s strong economy, migrant friendly policies and healthcare, but especially because their route to permeant residency and Canadian citizenship is so much faster easier than in other countries.  

The UK is also opening up new immigration routes post-Brexit having abandoned former Prime Minister David Cameron’s 2010 target of cutting net migration to the “tens of thousands”.

However, the UK government has pledged to clamp down on illegal immigration with plans to reduce the number of appeals against deportation.

In recent years, Indians have made up the largest nationality to obtain permanent residency in Canada. Migrants have been helped by a more straightforward path to citizenship, as well as schemes aimed at attracting entrepreneurs and highly skilled workers.

According to immigration analysts, the main reason behind increased migrants from the US to Canada is the confusion surrounding the H-1B scheme, as well as the extremely long waiting times for a US green card for Indians.

Marco E. L. Mendicino, Minister of Immigration, Refugees, and Citizenship said, “As we look to the future, newcomers create jobs not only by providing our businesses with the skills they need to thrive, but also by starting their own businesses.” He added, “Our plan will help to address some of our most pressing labour shortages while also increasing our population to keep Canada competitive on the global stage.”.

To fill critical labour market gaps and remain competitive on the global stage, the 2021-2023 levels plan aims to welcome immigrants at a rate of about 1% of the Canadian population, including 401,000 permanent residents in 2021, 411,000 in 2022, and 421,000 in 2023.

While Immigration, Refugees and Citizenship Canada (IRCC) continued to accept and process applications throughout the pandemic, global travel restrictions and capacity constraints resulted in a shortfall in admissions in recent months.

In my Money Tips Podcast this week, I interviewed Toronto native, Jas Takhar, co-founded the REC and real estate firm Royal LePage.

Jas, who runs one of the leading real estate companies in Canada and is the author of the book Real Estate Intelligence, pointed out that around three times more homes will need to be built to accommodate new arrivals as well as fast-growing local demand in a hot property market.  

Canada has been a popular destination for migrants from all over the world including Hong Kong, India, The Philippines, Africa and European countries. This is due to a number of factors, such as Canada’s strong economy, migrant friendly policies and healthcare, but especially because their route to permeant residency and Canadian citizenship is so much faster easier than in other countries.  

The UK is also opening up new immigration routes post-Brexit having abandoned former Prime Minister David Cameron’s 2010 target of cutting net migration to the “tens of thousands”.

However, the UK government has pledged to clamp down on illegal immigration with plans to reduce the number of appeals against deportation.

Four jailed over sham marriage scam UKBA reports

The UK Border Agency reports that four people have been jailed for a total of more than six years for their part in a sham marriage scam involving Nigerian and Dutch nationals.

The investigation was triggered when our officers identified the suspicious travel patterns of passengers flying in and out of Luton and Stansted Airports on tickets purchased by Adeolu Eletu, a 29-year-old Nigerian.

On 10 February, our officers from the immigration crime team (East), arrested Daniloush Solano, a 21-year-old Dutch woman, at Luton Airport as she attempted to board a flight to Amsterdam.

Investigations revealed that earlier that day Solano had married Eletu at a church in Wood Green, London. She was paid 1,500 euros for her role.

Eletu was subsequently arrested on 27 February at his home address in Falcon Brae, Livingston. His Nigerian girlfriend Helen Omoboye, 33, was also arrested. She had been due to participate in a sham marriage of her own at the same Wood Green venue on 11 February.

Sylvernus Ogungbade, a 36-year-old Nigerian, was also arrested on 10 February after officers established that Solano had caught her taxi to Luton Airport from his home in Goldbeater's Grove, Edgware. Immigration checks revealed that Ogungbade, who was living alone, had recently applied for a visa on the back of his marriage to a Dutch woman who is still wanted by us.

Last week at Luton Crown Court, Eletu, Ogungbade and Omoboye pleaded guilty to conspiring to breach the UK's immigration laws. Eletu and Omoboye also pleaded guilty to perjury charges.

Eletu was sentenced to two years eight months, Omoboye was sentenced to 18 months and Ogungbade was sentenced to a year and eight months. Solano had pleaded guilty to charges of conspiring to breach the UK's immigration laws and perjury at an earlier hearing on June 10. She was sentenced to 12 months.

Sam Bullimore, assistant director, UK Border Agency said:

'The sentences handed out show how seriously we, and the courts, take these kinds of attempts to undermine our immigration laws.

'We will not tolerate immigration abuse and, as these convictions demonstrate, our immigration crime teams are creating a hostile environment for those who break the immigration laws. We know that sham marriage rackets are not just about getting a ticket to the UK, often the offenders are also involved in other forms of criminality. If we see marriages that are not genuine, we will challenge them and prosecute where appropriate.

'People should be under no illusion that marriage is not enough to get permission to stay in the UK. Couples must also prove to the UK Border Agency that they have been in a genuine relationship for at least two years.'

Any foreign criminal sentenced to more than 12 months in prison for any offence is automatically considered for deportation. Source: UK Border Agency

Global Recession leading to stricter immigration rules

The effects of the recession have seeped into other aspects of policy around the world — including immigration.

Stemming from increased unemployment rates, many countries made changes to migrant policy that largely encouraged both migrant residents to leave and discouraged new immigration from beyond their borders, according to a study by the Federal Reserve Bank of Dallas.

As immigration rates rose between 2000 and 2007, unemployment rates rose in the two subsequent years in countries around the world, say Mike Nicholson and Pia Orrenius, the report’s authors. The migrant population in Spain, for instance, increased from just under 1 million in 2000 to almost 5 million in 2007. Spain’s unemployment rate jumped to 19% from 8.8% between December 2007 and December 2009. Immigration patterns in the U.S., however, remained unchanged from the 1990s as unemployment rose to 10% from 5%.

As a result, Ireland, Spain, the U.S. and the U.K. — among others — adopted policies that would limit immigrants’ access to the labor force. The Troubled Asset Relief Program in the U.S. discouraged banks receiving stimulus funding from hiring foreign workers, and an executive order this year created stricter regulations for foreign farm workers.

Ireland discontinued work permit issuance to immigrants for low-paid positions in 2009 and created stricter rules for work permit renewals. The U.K. increased salary and education standards for non-EU high-skilled workers and passed stricter citizenship requirements.

Many countries created policies that encouraged migrant residents to return to their home countries. Spain’s program, implemented in 2008, made two payments for unemployment benefits to migrants for leaving the country — one in Spain, the second after the person had returned home. Participation in the program prohibits return to Spain for three years. Japan and the Czech Republic created similar programs.

Overall, illegal migration has declined as authorities tighten enforcement on labor migration, though family and humanitarian migration has remained steady.

Effects of the migration resistance could peak after the recession ends, the authors say. Demand for labor and migration are expected to rebound as the economy recovers, but increased demand could clash with restrictions on foreigners in the labor market.

“These could impede countries’ ability to recruit workers in sectors vital to their recovery and long-run economic growth,” the authors say.

But some countries have already started reversing migration policies enacted during the recession. Switzerland, for example, has upped some of this year’s work permit quotas after cutting them in half at the beginning of the year, and Malaysia is permitting some foreign recruitment in manufacturing.

Canada immigration growing

Canada is in a unique position within the main countries to which people choose to emigrate, as they possess the world's most positive attitude to immigration.

It would be fair to say that this approach is not mirrored anywhere else in the world. 'Immigration Canada' is constantly updating policy to accommodate new issues and new problems that arise due to migrating workers.

These policy changes or introductions include:

Canada currently has a quota of 265,000 immigrants a year, which is unlikely to be lowered in the next 10 years.

This means that the Canada of today is vastly different to 20-years ago, and one could even go as far as to say it is vastly different to countries around the world.

No other country has such a fair and even policy or attitude. Reports about cities such as Toronto and Quebec constantly cite the multi-cultural feel of the areas as one of the over-riding factors people come away with. This is the result of those migrating to Canada and making it their home.

The largest ethnic groups resettling in Canada are the Chinese and Indian communities. These groups are culturally very hard-working and see the lifestyle and options Canada offers as immensely enriching.

Canada also offers a number of world beating public services that you would be hard-pressed to match anywhere else:

• Free public healthcare
• Free education
• Excellent transport links

These services re-enforce the belief that Canada is among the world's top 5 countries to live, while supporting the main pull factor of a blossoming and productive job market.

Most people emigrating to Canada rarely regret their decision, as they regard it as the best choice they ever made. It sometimes seems like the 'world wants to be Canadian'!

More interesting is the fact the people that talking to those who live live there you will be hard-pressed to find a Canadian that has moved away from the country permanently.
